Rights & Permission Policy
All requests to reproduce items from the holdings of the Concordia College Archives for publication, exhibition, or any commercial use must be submitted through the Permission to Use form. By signing this form, the applicant agrees to abide by all terms, conditions, and provisions of this agreement.
The College Archivist will review received permission forms and respond to each applicant’s request. Before materials are duplicated and sent to applicants, all fees must be paid in full. (Please note that the Concordia College Archives only accepts payments by cash or check). Some materials will take longer to process than others (e.g. videos), so please allow a minimum of one week to receive requested items.
The Concordia College Archives reserves the right to refuse any request. Refusals may be based on the physical condition of the items, copyright regulations, privacy rights, donor-imposed restrictions, or to ensure the use of material is reproduced in good taste.
Reproductions supplied by the Concordia College Archives cannot be reproduced, scanned, transmitted, sold, loaned, exhibited, deposited in another repository, or otherwise used for any purpose other than that specified in this agreement. Approved use is non-exclusive and for one time only (one time, one format, under one title). Permission to use terminates immediately upon publication or production of the specified product. Any subsequent use constitutes re-use and must be applied for at which time use fees will again be levied.
The applicant and Concordia College Archives agree that any photocopy or facsimile copy of this fully-executed agreement shall have the same legal force and effect as any copy bearing original signatures of the applicant and Concordia College Archives.
Property rights
The Concordia College Archives retains all intellectual property rights to the items requested for reproduction, and they are to be used only for the purpose listed on the permission form.
Copyright
The Concordia College Archives does not assume any responsibility for infringement of the copyright held by the author or heirs pertaining to Concordia Archives material. Researchers are responsible for determining copyright holders and obtaining permission from them. The Concordia Archives recognizes that copyright and restriction information may be difficult to ascertain and is willing to provide any copyright information it has available upon request. Users are responsible for legal determination of copyright which can be found by contacting the United States Copyright Office.
Privacy
The Concordia College Archives reserves the right to require written permission from individuals, families, or their heirs when the privacy of that individual or family may be violated by the reproduction of an image or item from its collections. Use of an image or voice of an identifiable individual in a manner which suggests association with or endorsement of a product, service, or agency is prohibited.
Waiver
The applicant agrees to hold Concordia College and its employees harmless against any and all claims arising or resulting from the use of the material and shall indemnify Concordia College and its employees from any and all costs arising or resulting from any such use.
Image integrity
Images must not be cropped, retouched, or altered in any way affecting their historical or artistic integrity unless approved in advance by the Concordia College Archives.
Documentation
The applicant is responsible for accurately recording identifications and other details pertaining to the items to be used.
Credit requirements
A credit line acknowledging the Concordia College Archives must be placed in an obvious and logical location in proximity to the reproduced material or in a dedicated credit section. All reproductions, including those produced electronically, must include credit and caption as part of the image. Payment of fees for commercial use does not exempt clients from the credit requirements. The following acknowledgement/credit line should be used:

The Concordia College Archives is a non-government, non-profit organization and must charge use fees to sustain its collections and programs. Use fees are in addition to any research or supply costs. The applicant is responsible for paying all use fees levied. Prepayment of all reproduction and use fees is required before permission is granted. - Usage fee: $20 per image (only for the commercial use of archival collections)
- Research fees: $5 flat fee for the first hour and $25 per hour thereafter
- CD/DVD reproduction: $5.00 per disc
- Postage: $3.00
